The following rules apply to KOCD-FM 103.7, its officers, shareholders, agents and employees hereinafter known as KESC Enterprises, LLC (KOCD), and to all entrants who enter any contest KOCD engages. In addition or in substitution of these general contest rules all entrants agree to these and any specific rules terms and conditions provided for by any particular contest.

 

No purchase is necessary to enter, except as otherwise provided in specific contest rules. Entrants must be at least 18 years of age, unless otherwise specified. Contests are open to legal residents of the United States. KOCD reserves the right to refuse to award a prize for any contest to or on behalf of a minor.

Only one winner per household is permitted to win every 30 days. By participating in a contest with KOCD the winner or winners agree to have their name, place of employment, voice or other likeness used in any broadcasting or advertising material and become property of KOCD and may be used for any purpose whatsoever, without further compensation to the entrant. Winners will be selected as described in the specific rules of each contest. Winners agree to appear at KOCD studios to claim the prize, unless alternate arrangements are acceptable to KOCD.

 

Payment of all federal, state and local taxes is the sole responsibility of the winner. Winners may be required to sign an IRS Form 1099 or the equivalent if prize or combination of prizes for the current calendar year totals over $599.99.

 

Decisions of KOCD with respect to all contests matters shall be conclusive and final.

Contest prizes are non-transferable and non-exchangeable. No substitution or cash equivalent will be made. KOCD reserves the right to substitute a prize of equal or greater value if the awarded prize in unavailable for any reason. KOCD is not responsible for any cancellations, delays, or rescheduling of any prize awarded. KOCD shall under no circumstances be liable whether in contract, tort, statute or otherwise for any special direct, indirect or consequential loss or damage which is suffered, sustained or incurred arising directly or indirectly from or out or relating to prize awarded and entrant shall hold KOCD harmless against any and all claims or liability arising directly or indirectly from the prize or contest participation. All entrants and of entrant’s heirs, personal representatives, successor or assigns, do hereby covenant not to sue KOCD, and fully release and forever discharge KOCD and its successors and assigns thereof, from and against any and all claims, losses, actions, charges, damages, expenses, costs (including attorney fees and expenses) and liabilities of any kind, or character, whether known or unknown, in connection with, arising out of or in any way related to entrant’s participation in any contest.

 

All employees of KOCD, participating sponsors/promotional partners, affiliated advertising agencies and members of their immediate families are ineligible to participate or win.

All prizes should be picked up at the office of station during normal office hours. (Monday—Friday from 9am-5pm), excluding holidays. (KOCD, Seminole, Oklahoma) winner will forfeit any prize not picked up within 30 days of winning for any reason. If prize won is time/date sensitive and not picked up by 5pm of the last day it is available for use, it will be considered forfeited. KOCD reserves the right to make other arrangements such as mail or delivery service, at it discretion to delivery prizes. KOCD is not responsible for mail or delivery errors.

When contest winners may be required to call-in to win, if so, they must use only the phone number specified on the air. The person operating the telephones at KOCD has the final decision as to who is the winning caller. KOCD assumes no responsibility for any problems with telephone service, internet or email. If you’re listening to the internet stream, programming may be delayed affecting contest participation.

 

In the event a contest accepts entry from by deposit in entry boxes, KOCD and its sponsors are not responsible for misplaced, mutilated, lost, illegible, or incomplete entry forms and such entries will be deemed invalid.

 

In the event of a contest accepting fax, electronic, drop box entry and mail, KOCD and it’s sponsors are not responsible for misdirected, late, illegible, mutilated, lost, misplaced or incomplete entry for any reason, including disconnection, malfunctions, faulty lines, busy lines, mistranscribed, that may affect the delivery or content of entry.

 

For the winning name or names on one of our contest or for a copy of contest rules, you may request it in person or send a self-address stamped envelope to (KOCD, Tulsa, Oklahoma) and include the name and date of the contest and it will be mailed to you within 10 business days. Winner names will be kept on file for 1 year from date of winning.

 

These contest rules apply to all KOCD contest unless otherwise specified in writing for a specific contest, which those rules would prevail. KOCD reserves the right to interpret the rules and make changes at any time without notice.
